In the following document, the terms "we", "us", or "our" shall refer to Hexenon Hosting. The terms "you", "your", "User", or "customer" shall refer to any individual who accepts this Terms of Service agreement by using this site or any services found and offered at this site. Nothing in this Terms of Service document shall be deemed to confer any third-party rights or benefits. By using this site, you represent and warrant that you are (i) at least eighteen (18) years of age and/or (ii) otherwise recognized as being able to form legally binding contracts under applicable law. If you are under the age of eighteen, you agree that you have a parent or guardian who is able to be legally binded into a legal contract.
In the case that you are agreeing to these Terms of Services on behalf of a corporate or enterprise entity, you represent and warrant that you have the full legal authority to bind such corporate entities to these Terms of Services. In the case that Hexenon Hosting finds that you do not have the legal authority to bind such corporate entity to this Terms of Services, you will be held personally responsible for the obligations stated in these Terms of Services.
We are a United States of America based hosting company with servers in multiple countries around the globe. Thus, there are some exceptions to this Terms of Service, however proper consent must be gained before performing the action in question. We, Hexenon Hosting reserve all rights to change this Terms of Service document at any time and date without any prior notice given to you (referred to as the "client"). If you are found breaching this contract, then we reserve the right to remove any content and/or suspend the website and service in question without any prior notice.
While we do try our best to maintain our servers to their tip-top condition, there are always mistakes that happen. Should an event such as data loss happen with one of our servers due to hardware or software issues, a malicious attack, or other type of error, we cannot be held liable for this issue. While Hexenon does our best to secure the best possible experience with any hosting service, our backup services do at some points fail, and we ask you as the client to create and download your own backups in case any issues may arise with our network/servers.
While Hexenon Hosting is a US based company with trained staff and technicians on our system, there are always problems that may cause downtime on servers. These include but are not limited to: D/DOS Attacks, Rootkits, Network Outages, Power Outages, and System Outages. Hexenon Hosting offers a conditional 99% Uptime Guarantee, though this guarentee is controlled by the type and reason of downtime. Hexenon Hosting reserves the right to ignore the 99% Uptime Guarantee if the reason for the outage is out of our hands. Additionally, scheduled downtime for server transfers, upgrades, maintenance, and even backups are also not covered under the 99% Uptime Guarantee.
Unfortunately, at the moment, Hexenon Hosting has a no return policy on our services. In this industry, with each service purchased, there are associative license fees that we must pay on immediate creations of services. Hence, these license fees cannot be refunded and your services cannot be canceled. Should you need to contact us regarding this policy for whatever reason, it is possible that we will be able to waive the policy in event that we see fit. Additionally, given that a client misses a payment and the payment is overdue for more than 7 days, the service will be cancelled at the discretion of the Hexenon Systems Manager. However, prior to this condition, if the payment is missed for a total of 3 days after the invoice due date, the service will be suspended and frozen in a state in which the client will not be able to modify or access the system. If a client wishes to restore their service to a state before it was deleted, they should contact the Hexenon Technical Support Team to determine the necessary steps required for the restore. On most of the Hexenon Nodes, backups are only kept for a limited amount of time, and in some circumstances, it will not be possible to restore backups.
Web Hosting -
You may not host the following type of content on any web hosting account with us.
1. Any adult content such as pornography.
2. Any copyrighted material that is not either licensed or rightfully yours.
3. Any use of our systems to send spam email to any email addresses.
4. Any type of script to attempt an override of our security features on our server (Rootkits).
5. Any use of nulled software.
6. Use of any script that would cause another entity harm, either physical or mental.
Minecraft Server Hosting -
You may not host the following types of servers with us.
1. Any server that purposely allows illegally downloaded Minecraft clients to connect.
2. Any type of server which is not being used in the correct licensing agreement that the actual server binary provider has agreed to.
3. Any type of server which is designed to slow down the service of the Hexenon Network.
4. Any type of server which is specifically meant to mean harm or racial thoughts.
